Terms of Application for Business Partners (Manufacturers)<\/strong><\/strong><\/p>\n\n\n\n

Conditions of Implementation for Business Partners (Manufacturers) to be included in the amfori BSCI audit process<\/p>\n\n\n\n

I. Introduction                                                         <\/h1>\n\n\n\n

For the purposes of this document, \u201cManufacturers\u201d<\/strong> means a business partner that manufactures products (food or non-food) or produces raw materials in the amfori BSCI Participant’s supply chain and that has been included in the amfori BSCI audit process as a result of the amfori BSCI Participant’s or Business Partner’s due diligence.<\/p>\n\n\n\n

This decision can be made directly by an amfori BSCI Participant or through an amfori BSCI Participant’s business partner.<\/p>\n\n\n\n

amfori BSCI Participants reserve the right to include and exclude the producer from the audit process at any time as a result of their risk definition.<\/p>\n\n\n\n

By signing these Terms of Implementation, producers embrace the values and principles of the amfori BSCI Code of Conduct and undertake to take appropriate measures in their own facilities to observe the principles of the amfori BSCI Code of Conduct.<\/p>\n\n\n\n

In addition, they involve relevant key business partners in the process of acting responsibly.<\/p>\n\n\n\n

II. Commitment to socially responsible trade   <\/h1>\n\n\n\n

Producers who take on the responsibilities set out in the amfori BSCI Code of Conduct work with amfori BSCI Participants to engage in an open and constructive dialogue with their stakeholders towards the implementation of the amfori BSCI Code of Conduct.<\/p>\n\n\n\n

Producers actively communicate their approval of the amfori BSCI Code of Conduct to their business partners through the company organization. Producers should display the amfori BSCI Code of Conduct in an open and accessible place, in the local language.<\/p>\n\n\n\n

Producers verify that they have read and understood the Terms of Implementation of the amfori BSCI Code of Conduct and undertake to work towards their full observance within their sphere of influence.<\/p>\n\n\n\n

Producers shall maintain the necessary procedures and adequate resources to meet their responsibilities regarding the amfori BSCI Code of Conduct and to ensure continuous improvement in its implementation.<\/p>\n\n\n\n

Producers mandate significant business partners to work towards full compliance with the amfori BSCI Code of Conduct and take reasonable measures to ensure that the amfori BSCI Code of Conduct applies to their business partners within their sphere of influence.<\/p>\n\n\n\n

Producers acknowledge that any breach of the values and principles set forth in the amfori BSCI Code of Conduct and\/or any of the provisions of these Terms of Practice is sufficient grounds for amfori BSCI Participants or their relevant business partners to terminate their business relationship with the signatory producer. In this context, the burden of proof rests with amfori BSCI Participants or their business partners, as appropriate.<\/p>\n\n\n\n

III. Incorporating social responsibility into the corporate culture of the enterprise\u00a0\u00a0\u00a0\u00a0<\/sub>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/h1>\n\n\n\n

Manufacturers should establish good management practices that involve employees and their representatives in sharing accurate information on workplace issues.<\/p>\n\n\n\n

Producers should establish and maintain policies and procedures to ensure that the principles of the amfori BSCI Code of Conduct are followed and workers are appropriately protected.<\/p>\n\n\n\n

Producers shall take the necessary actions to make workers aware of their rights and responsibilities, especially the most disadvantaged groups (eg immigrant workers).<\/p>\n\n\n\n

Producers must ensure adequate alignment between managers and employees to incorporate the amfori BSCI Code of Conduct into their corporate culture. Production, Human Resources and other relevant departments (or individuals) should be trained and encouraged to contribute to the incorporation of socially responsible business principles into the corporate culture.<\/p>\n\n\n\n

IV. Cooperation and authorization in supply chains and within own facilities<\/h1>\n\n\n\n
  1. Producers should support and train their own employees to<\/strong> build the necessary capacities to implement and maintain the principles of the amfori BSCI Code of Conduct.<\/li>
  2. Producers should aim to have a constructive and open dialogue with workers and worker representatives regarding their responsibility to observe the principles of the amfori BSCI Code of Conduct.<\/strong><\/li><\/ol>\n\n\n\n

    4,3.\u00a0Producers should engage in a constructive and open dialogue with key business partners about their competence to comply with the amfori BSCI Code of Conduct<\/strong> and assist them in satisfying these expectations.<\/p>\n\n\n\n

    V. Due diligence in own facilities and supply chains<\/strong><\/h1>\n\n\n\n
    1. Producers must (a) assess the actual and potential negative impacts of their business on the values and principles of the amfori BSCI Code of Conduct; (b) identify the points, including the negative impact of the most significant risks may arise in their plants and supply chain and (c) be committed to acting diligently to prevent them and\/or take action to deal with them within the amfori BSCI Code of Conduct.<\/li><\/ol>\n\n\n\n
      1. Producers obtain reliable information about the responsible behavior of their businesses and business partners, evaluate them, and keep documents that will constitute the necessary proof that they act with care. In cases of non-compliance with the principles of the amfori BSCI Code of Conduct, it investigates the root causes in detail and takes the necessary corrective actions.<\/li>
      2. Producers require their business partners to regularly report on their progress in implementing and\/or maintaining the amfori BSCI Code of Conduct, as well as the level of effectiveness of interventions in situations in which they are involved that may adversely affect the values and principles of the amfori BSCI Code of Conduct.<\/li>
      3. Producers should establish an effective complaint mechanism at the enterprise level or participate in such mechanisms as much as possible in order to intervene with individuals (especially their employees) and communities that may be adversely affected by their activities.<\/li><\/ol>\n\n\n\n

        VI. Information management\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/sub>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/h1>\n\n\n\n
        1. Producers shall provide accurate reporting to amfori BSCI Participants on the effectiveness of their interventions in situations that may adversely affect the values and principles of the amfori BSCI Code of Conduct, as well as their implementation plan and continuous improvement.<\/li>
        2. Producers shall seek consultancy to understand the concerns of potentially affected stakeholders, from whom they can seek advice or consult with trusted, independent external experts. This includes representatives of governments, non-governmental organizations and workers to verify the effectiveness of the implementation process.<\/li>
        3. Producers undertake to immediately inform the amfori BSCI Participant of any non-compliance that may have a negative impact on the values and principles of the amfori BSCI Code of Conduct for themselves and\/or their partners, especially subcontractors.<\/li><\/ol>\n\n\n\n

          VII. Audit for improvements                 <\/strong><\/h1>\n\n\n\n
          1. Producers conduct audits to ensure that the amfori BSCI Code of Conduct is complied with by them and their business partners, which are included in the production process based on a development-oriented approach.<\/li>
          2. Producers are aware of the importance of having relationships based on trust and shall not be a party to the falsification of any information, especially written documents, in monitoring their performance in observing the amfori BSCI Code of Conduct.<\/li>
          3. Producers acknowledge that individual auditors working on behalf of an Auditing Company performing amfori BSCI audits or representing an Auditing Company in any way may collect the necessary written evidence. This includes, but is not limited to, pictures of the production facility(s) as well as copies of audit-related business documents.<\/li>
          4. Producers acknowledge that confidential meetings can be held with the worker representatives and workers chosen by the inspectors themselves, without any influence from the producer.<\/li>
          5. Producers agree that all audit information shall be recorded on the amfori BSCI Platform<\/strong>. This Platform is a medium that enables the sharing of audit reports among amfori BSCI Participants.<\/li>
          6. Producers acknowledge that, As long as the information collected at their facilities during the amfori BSCI Audit (i) is within the framework of amfori BSCI; (ii) when such sharing is required by or on behalf of amfori\/amfori BSCI-related activities, and\/or (iii) with third parties as long as the third parties undertake to treat the information provided with the utmost respect and treat it only in the context of the case.<\/li>
          7. Producers acknowledge that amfori BSCI Auditors may be subject to Witness Audits when conducting amfori BSCI audits at their premises. Witness Audits aim to measure the quality of Auditors \/ Audit Firms conducting amfori BSCI audits. Therefore, there shall be no impact on the producer’s performance or inspection results, and no additional fees shall be required from the producer. Producers acknowledge that amfori BSCI social audits may include a Witness Auditor upon request and access should be provided to the facility for additional Auditors.<\/li><\/ol>\n\n\n\n
            1. Producers acknowledge that their facilities and production sites may be subject to investigative measures under the amfori BSCI Integrity Program;<\/strong> this program includes, but is not limited to, Witness Checks, Duplicate Checks, and Random Unannounced Checks (RUC). If the result of the RUC differs adversely from the result of the previous inspection, the entire cost of the RUC is borne by the Producer.<\/li><\/ol>\n\n\n\n
