These rules were approved by the Foreign Trade Association Board of Directors (amfori as of 1\/1\/2018) on 28 November 2013 and supersede the 2009 version of the amfori BSCI Code of Conduct, including all translations. The current amfori BSCI Code of Conduct consists of three main parts: a) Introduction, Comment, Our Values and Practice applicable to all Business Entities; b) Principles specifically for BSCI Participants&#8217; Business Partners; and c) amfori BSCI Terms of Practice, amfori BSCI References and amfori BSCI Glossary, which form an integral part of the Code and contain more detailed information on the interpretation and application of amfori BSCI.<\/p>\n\n\n\n<p>Version 1\/2014 of the amfori BSCI Code of Conduct will enter into force on 1 January 2014. The legally binding version of this document is English version<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">I. Introduction&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/h1>\n\n\n\n<p>amfori (BSCI) was founded by the Foreign Trade Association with the awareness that international trade is an important tool for people&#8217;s welfare and social economic development.<\/p>\n\n\n\n<p>This code of conduct (the amfori BSCI Code of Conduct) consists of a set of principles and values that reflect the ideas of amfori BSCI Participants and their expectations from their business partners.<\/p>\n\n\n\n<p>amfori BSCI Code of Conduct refers to international conventions such as Universal Declaration of Human Rights, the Rights of the Child and Business Principles, the UN Guiding Principles on Trade and Human Rights, OECD Guidelines, the UN Global Compact, and the International Labor Organization (ILO) Conventions and Recommendations on improving working conditions in the supply chain.<\/p>\n\n\n\n<p>Enterprises that adopt the amfori BSCI Code of Conduct are committed to fulfilling their responsibilities to respect the principles set out in this document and to respect human rights within their sphere of influence.<\/p>\n\n\n\n<p>amfori BSCI and its participants (amfori BSCI Participants) pursue a constructive and open dialogue between business partners and stakeholders for the implementation of socially responsible business principles.<\/p>\n\n\n\n<p><strong>\u00a9 Copyright 2017 amfori, Brussels<\/strong><\/p>\n\n\n\n<p>They also see the establishment of mature industrial relations between employees and management as a key element of sustainable businesses.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">II.Interpretation&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/h1>\n\n\n\n<p>In the amfori BSCI Code of Conduct, the term &#8220;enterprise&#8221; includes both amfori BSCI Participants and Business Partners in the supply chain, in particular Manufacturers.<\/p>\n\n\n\n<p>The appendices referenced at the end of the amfori BSCI Code of Conduct (Terms of Implementation, amfori BSCI References and amfori BSCI Glossary) form an integral part of the amfori BSCI Code of Conduct. The amfori BSCI Code of Conduct should be read and interpreted in conjunction with these appendices.<\/p>\n\n\n\n<p>Each enterprise has different Implementation Conditions to comply with depending on their role in the supply chain and whether or not they are audited by amfori BSCI.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">III.Our Values&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/h1>\n\n\n\n<p>By adopting the amfori BSCI Code of Conduct and communicating it to their supply chain, amfori BSCI Participants are guided by the following values:<\/p>\n\n\n\n<p>Continuous improvement: amfori BSCI Participants are committed to implementing the amfori BSCI Code of Conduct with a progressive development approach. amfori BSCI Participants expect their business partners to ensure continuous improvement in working conditions within their organizations.<\/p>\n\n\n\n<p>Cooperation: By working together and taking a common approach, amfori BSCI Participants will have a greater impact on working conditions in their supply chains, increasing the possibilities for improving conditions. The value of collaboration is equally important in dealing with business partners in the supply chain, especially those who need support to thrive.<\/p>\n\n\n\n<p>Similarly, the spirit of collaboration is critical to the relationship between businesses and the different levels of stakeholders affected by it.<\/p>\n\n\n\n<p>Authorization: One of the key objectives of amfori BSCI is to ensure that amfori BSCI Participants and their business partners, particularly the producers to be audited, develop their supply chains in a way that respects human and labor rights, as well as providing business units with the necessary tools to sustainable improve working conditions in the supply chain. is to authorize. Developing internal management systems is critical in placing amfori BSCI principles at the center of their business culture.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">IV. Implementation&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/h1>\n\n\n\n<p>The principles set out in the amfori BSCI Code of Conduct represent amfori BSCI Participants&#8217; desired goals and minimum expectations regarding the social behavior of their supply chains.<\/p>\n\n\n\n<p>Although the desired goals will not change, the minimum expectations of the amfori BSCI Code of Conduct, translated into verifiable social standards, may differ according to changes in society.<\/p>\n\n\n\n<p>amfori BSCI Participants undertake to use reasonable efforts to achieve the objectives set out in the amfori BSCI Code of Conduct. Although amfori BSCI Participants cannot undertake to monitor their business partners at all times, they commit to take reasonable precautions to comply with the principles of the amfori BSCI Code of Conduct, particularly in regions and\/or sectors where the risks of observing the amfori BSCI Code of Conduct are high.&nbsp; Of course, thorough surveillance is a process that takes a lot of time, resources, and effort, and it&#8217;s always possible for gaps, lacks, disruptions, and unexpected situations to arise. Despite this, amfori BSCI Participants are highly committed to early detection, monitoring and remediation of such disruptions in their supply chains and will be very open to engaging constructively with stakeholders who have genuine concerns about social compliance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Observance of the Rules<\/h2>\n\n\n\n<p>Compliance with local laws is the first obligation of enterprises. In countries where local laws and regulations conflict with or offer a different standard of protection from the amfori BSCI Code of Conduct, businesses should seek to comply with principles that provide the highest level of protection for employees and the environment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Supply Chain Management and Gradual Impact<\/h2>\n\n\n\n<p>amfori BSCI Participants are aware of their purchasing activities and their capacity to influence social changes in their supply chains. They conduct their relations with all business partners responsibly and expect the same in return.<\/p>\n\n\n\n<p>This is requires a collaboration approach where each enterprise (a) engages its relevant business partners, (b) takes all reasonable and appropriate measures within its sphere of influence necessary to implement the amfori BSCI Code of Conduct, and (c) exchanges information to identify challenges that need to be mitigated in a timely manner.<\/p>\n\n\n\n<p>amfori BSCI Participants and business partners will work to detail the root causes of any adverse human rights impacts, particularly when purchasing from high-risk regions or sectors. In order to establish this sense of responsibility, businesses should take due care and establish the necessary management systems, policies and procedures in a reasonable framework, as well as effectively prevent and deal with all negative impacts on human rights that can be detected in the supply chain.<\/p>\n\n\n\n<p>In-house management systems are particularly recommended as an effective method for incorporating the amfori BSCI Code of Conduct into business practices for producers to be audited.<\/p>\n\n\n\n<p>Termination of a business relationship or individual contract with a business partner is seen as a last resort due to difficulties in implementing the amfori BSCI Code of Conduct. However, if the business partner does not act in accordance with the principles set out in the amfori BSCI Code of Conduct and\/or the business partner is unwilling to take the necessary measures to fulfill the obligations set forth in the amfori BSCI Code of Conduct and\/or specific to these rules, the business relationship or individual Termination of the contract may be necessary.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Inclusion and Protection of Employees<\/h2>\n\n\n\n<p>Enterprises should develop good management practices whereby employees and their representatives can properly exchange information on workplace issues and take appropriate action to protect employees in line with the objectives set out in the amfori BSCI Code of Conduct. Enterprises should take specific steps to inform employees of their rights and responsibilities.<\/p>\n\n\n\n<p>In addition, enterprises must ensure that a coherent competence is developed between employers, managers, workers and worker representatives so that these practices can be successfully incorporated into business activities. In this regard, it is essential to provide continuous training at all levels of the work, especially Occupational Health and Safety.<\/p>\n\n\n\n<p>Enterprises should establish or participate in effective business-level grievance mechanisms for individuals and communities that may be adversely affected. Even where justice systems are efficient and adequately resourced, complaint mechanisms offer advantages such as rapid access and remediation, low cost and transnational accessibility.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">V.Principles&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/h1>\n\n\n\n<p>amfori BSCI Participants expect all business partners to comply with the amfori BSCI Code of Conduct. In addition, business partners audited according to the following principles must show evidence of taking action (a) take all necessary steps to ensure that they comply with the amfori BSCI Code of Conduct, and (b) make all reasonable efforts to ensure that all business partners involved in the production process(s) comply with the amfori BSCI Code of Conduct.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Freedom of Organizing and Collective Bargaining Rights<\/h2>\n\n\n\n<p>Business partners: (a) should respect the right of workers to form trade unions freely and democratically, (b) should not discriminate among workers on the basis of union membership, and (c) should respect workers&#8217; right to collective bargaining.<\/p>\n\n\n\n<p>Business partners must not prevent worker representatives from accessing or interacting with workers in the workplace.<\/p>\n\n\n\n<p>In countries where union activities are illegal or where free and democratic union activities are not permitted, business partners shall comply with this principle by allowing employees to freely choose a representative with whom the company can engage in dialogue about workplace issues.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Non-Discrimination<\/h2>\n\n\n\n<p>Business partners cannot exclude people for their gender, age, creed, race, social class, ancestry, social background, disability, ethnic and national origin, nationality, membership of trade unions or other legal organizations, political affiliations or opinions, sexual orientation, family responsibilities, marital status, illness or any other circumstance that may cause discrimination, cannot prefer certain people, or discriminate against people based on these factors. In particular, workers cannot be harassed or punished for the reasons mentioned above.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Fair Wage<\/h2>\n\n\n\n<p>Business partners shall abide by this principle by respecting workers&#8217; right to a fair wage sufficient to provide a decent life for themselves and their families, as well as social rights granted by law, without disregarding the expectations set by these rules.<\/p>\n\n\n\n<p>As a minimum, business partners are obligated to comply with wages mandated by government minimum wage legislation or industry standards approved on a collective bargaining basis, whichever is higher.<\/p>\n\n\n\n<p>Wages must be paid on time, regularly and in full in the national currency. Partial payments made in the form of \u201cin-kind\u201d appropriations are accepted in line with the ILO specifications. Wage levels should reflect the skill and education level of workers and should refer to normal working hours.<\/p>\n\n\n\n<p>Deductions shall only be allowed under the conditions stipulated by law and to the extent permitted by law or as specified in the collective agreement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Decent Working Hours<\/h2>\n\n\n\n<p>Business partners shall abide by this principle by assuring that workers are not expected to work more than 48 normal working hours per week, without disregarding the expectations set under these rules. However, amfori BSCI recognizes exceptions set by the ILO.<\/p>\n\n\n\n<p>Applicable national laws, industry benchmark standards or collective agreements should be interpreted within the international framework laid down by the ILO.<\/p>\n\n\n\n<p>In exceptional circumstances as defined by the ILO, the above-mentioned working periods may be exceeded; overtime is allowed in these cases.<\/p>\n\n\n\n<p>The use of overtime must be exceptional, voluntary, and paid at not less than one plus one-fourth of the regular wage, but must not constitute a circumstance that significantly increases the likelihood of occupational hazard. Moreover, Business Partners must entitle their employees to rest breaks during each working day and at least one day off every seven days, unless the exceptions defined by the collective agreements apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Occupational Health and Safety<\/h2>\n\n\n\n<p>Business partners shall abide by this principle by respecting the healthy working and living conditions of employees and local people, without ignoring the expectations set within the framework of these rules. Vulnerable individuals such as, but not limited to, young workers, new mothers and expectant women, and persons with disabilities shall work under special protection.<\/p>\n\n\n\n<p>Business partners must comply with occupational health and safety regulations or international standards where local laws are weak or not adequately enforced.<\/p>\n\n\n\n<p>Active cooperation between management and workers and\/or their representatives is of great importance in developing and implementing systems to provide a healthy and safe working environment. This can be achieved by establishing Occupational Health and Safety Committees.<\/p>\n\n\n\n<p>Business partners must ensure that systems are in place to detect, assess, avoid and respond to potential hazards to employee health and safety. These individuals must take effective measures to prevent workers from work-related, work-related or work-related accidents, injuries or illnesses. These measures should aim to reduce the causes of workplace-specific hazards to the most reasonable minimum possible.<\/p>\n\n\n\n<p>Business partners should look for ways to improve employee protection in accident situations, including through compulsory insurance systems.<\/p>\n\n\n\n<p>Business partners should take all appropriate measures within their sphere of influence to protect against all foreseeable emergencies, as well as to take care of the stability and safety of the equipment and building they use, including dormitory facilities if provided by the employer. Business partners must respect employees&#8217; right to leave the facility without permission in imminent danger situations.<\/p>\n\n\n\n<p>Business partners should ensure that adequate occupational health support and related facilities are provided.<\/p>\n\n\n\n<p>Business partners must provide access to drinking water, safe and clean eating and recreation areas, and clean and safe cooking and food storage areas. In addition, business partners should always provide employees with effective Personal Protective Equipment (PPE) free of charge.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Prevention of Child Labor<\/h2>\n\n\n\n<p>Business partners shall comply with this principle by not directly or indirectly hiring minors, who are not younger than the minimum age to complete the compulsory education process determined by law, and not younger than 15, with the exceptions defined by the ILO.<\/p>\n\n\n\n<p>Business partners should establish robust age verification mechanisms as part of the hiring process so that they do not humiliate or disrespect the worker.&nbsp;&nbsp;&nbsp; This principle aims to protect children from all forms of abuse. Special care should be taken in the dismissal of children as they may move into more dangerous jobs such as prostitution or drug dealing. During the removal of children from the workplace, business partners should act proactively and identify and take the necessary measures to protect the affected child. Where applicable, the possibility of finding suitable employment for adults in the family of the affected child should be considered.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Special Protection for Young Workers<\/h2>\n\n\n\n<p>Business partners shall comply with this principle by ensuring that young employees do not work at night and are protected from conditions unfavorable for their health, safety, moral values and development, without ignoring the expectations set within the framework of these rules.<\/p>\n\n\n\n<p>Where young workers are recruited, business partners shall ensure (a) the job is not of a nature to affect their health or development; (b) ensure that working hours do not affect their attendance at school, their participation in professional integration processes approved by competent authorities, or their capacity to benefit from training programs.<\/p>\n\n\n\n<p>Business partners should establish mechanisms to prevent, identify and reduce harm to young workers, with particular emphasis on ensuring that young workers have access to effective grievance mechanisms and Occupational Health and Safety training systems and programs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Preventing Labor without Security<\/h2>\n\n\n\n<p>Business partners shall ensure, without disregarding the expectations set in this Code, (a) prevent their employment relationship from causing insecurity and social or economic hardship for their employees; (b) comply with this principle, ensuring that work is performed on the basis of a recognized and documented employment relationship in accordance with national legislation, custom or practice, and international labor standards, whichever provides the higher level of protection.<\/p>\n\n\n\n<p>Business partners must provide employees with understandable information about their rights, responsibilities and working conditions, including working hours, wages and payment terms, prior to employment.<\/p>\n\n\n\n<p>Business partners should aim to provide suitable working conditions that support the role of all workers, men and women, as parents or caregivers, particularly migrant workers and seasonal workers whose children may remain in their home country.<\/p>\n\n\n\n<p>Business partners should not resort to business arrangements that are not in line with the essential purpose of the law. This includes, without limitation, (a) apprenticeship programs with no intent to develop skills or provide regular employment, (b) seasonal or contingent jobs offered to narrow workers&#8217; protection coverage, and (c) labor-only contracts. In addition, the use of subcontractors should not occur in a way that insults employee rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Prevention of Payment of Debts by Labor<\/h2>\n\n\n\n<p>Business partners should not resort to any system such as vassalage, forced labor, labor bonding, permanent apprenticeship, illegal or involuntary employment.<\/p>\n\n\n\n<p>Business partners may be charged with complicity if their business partners benefit from their workforce in this way.<\/p>\n\n\n\n<p>Business partners should take special care when they directly or indirectly employ workers.<\/p>\n\n\n\n<p>Business partners should give their employees the right to leave and terminate their employment freely, provided that they give reasonable notice to the employer.<\/p>\n\n\n\n<p>Business partners must ensure that their employees are not subjected to inhumane or degrading treatment, corporal punishment, mental or physical coercion, and\/or verbal abuse.<\/p>\n\n\n\n<p>All criminal procedures must be determined in writing and explained to employees orally in a clear and understandable manner.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Environmental Protection<\/h2>\n\n\n\n<p>Business partners shall comply with this principle by taking the necessary measures to prevent damage to the environment, without ignoring the expectations set within the framework of these rules.<\/p>\n\n\n\n<p>Business partners should assess the significant environmental impacts of their activities and establish effective policies and procedures that reflect their responsibilities towards the environment. They shall ensure that appropriate measures are taken to prevent or minimize adverse effects on society, natural resources and the general environment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ethical Business Conduct<\/h2>\n\n\n\n<p>Without disregarding the goals and expectations set forth in this section, business partners shall not engage in any form of bribery, including, without limitation, by promising, offering, giving or receiving any corruption, fraud or embezzlement or any other form of encouragement, material or otherwise regardless of the form, and thus&nbsp; shall comply with this principle<\/p>\n\n\n\n<p>Business partners are expected to maintain accurate information regarding their activities, structures and performance and to report it in accordance with applicable regulations and industry benchmark practices.<\/p>\n\n\n\n<p>Business partners must not be involved in falsifying such information or in any misrepresentation in the supply chain.<\/p>\n\n\n\n<p>In addition, they must exercise reasonable care in the collection, use and other processing of personal information (including information they receive from workers, business partners, customers and consumers in their domains). The collection, use and other processing of personal data must comply with privacy and information security laws and regulatory requirements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">VI.
